By accessing the Platform, using the Services and submitting information, you acknowledge and agree that you accept the practices, requirements, and/or policies outlined in this Privacy Policy, and you hereby consent to us and our affiliates collecting, using, disclosing and/or processing your personal data and Targeting Data as described herein in accordance with this Privacy Policy. If the End-User does not agree to be bound by the terms of this Privacy Policy as set-out below, the End-User may choose not to access or use the Platform. To the fullest extent permissible under applicable law, your continued use of the Services or Platform, including placing of any orders, shall constitute your acknowledgment and acceptance of the changes made to this Privacy Policy.
(Collectively, hereinafter the ‘Platform’ and the ‘End-User’ shall be referred to as the “Parties” and individually as the “Party”)
1. Interpretations:
In this Privacy Policy (unless the context requires otherwise):
1.1 Any reference herein to any clause is to such Clause of this Privacy Policy.
1.2 The expression “this Clause” shall, unless followed by a reference to a specific provision, be deemed to refer to the whole Clause (not merely the sub-clause, paragraph or other provision) in which the expression occurs.
1.3 The terms “herein”, “hereof”, “hereto”, “hereunder” and words of similar purport refer to this Privacy Policy as a whole.
1.4 The headings are inserted for convenience only and shall not affect the construction of this Privacy Policy.
1.5 Words importing the singular include the plural and vice versa, and pronouns importing a gender include each of the masculine, feminine and neuter genders.
1.6 Any date or period as set out in any Clause of this Privacy Policy may be extended with the written consent of the Parties, failing which, time shall be of the essence.
1.7 Time periods within or following which any payment is to be made or act is to be done shall be calculated by excluding the day on which the period commences and including the day on which the period ends and by extending the period to the following business day if the last day of such period is not a business day.
1.8 Where a word or phrase is defined, other parts of speech and grammatical forms and the cognate variations of that word or phrase shall have corresponding meanings.
1.9 Reference to statutory provisions shall be construed as meaning and including references also to any amendment, consolidation, replacement or re-enactment (whether before or after the date of this Privacy Policy) for the time being in force and to all statutory instruments, orders or other subordinate legislation made pursuant to such statutory provisions.
2. Scope of Applicability:
Please note that privacy of the End-User is important to us. We value the trust of the End-User and are committed to protecting and safeguarding the End-User’s Data (defined below). This Privacy Policy, which we may update from time to time in the manner provided under Clause 9 of this Privacy Policy, describes inter alia how OurBus Indiashall use the End-User’s Data (defined below). It also tells the End-User how the End-User can contact us, if the End-User has questions about the End-User’s Data (defined below) shared with us.
The Platform provides an online marketplace for the sale of travel services inter alia through its own Platforms and mobile apps.
If you object to your information being transferred or used, please do not use the Platform.
3. Nature of End-User’s Data:
When the End-User makes a reservation/booking or register or join any contest or subscribe to any Services through the Platform, the End-User may be asked the required information including, without limitation:
3.1 Profiling Information: Information, which you provide when you use, subscribe or register with the Platform. Information about your identity, including but not limiting to, your name/guest name, nationality, gender, marital status, age, your email address, room preference, meal preference, special needs (if any);
3.2 Financial information, such as, your banking details and any information relating to your income and lifestyle levels;
3.3 Contact details such as your physical addresses, postal addresses, telephone and fax numbers;
3.4 Payment and Account Information: Your account history with us including (without limitation) all billing information and communications, payment history etc;
3.5 Platform Usage: Information about your navigation while using the Platform, for example the URLs of Platforms, which you visit and from which you request downloads;
3.6 Transactional Information: Transactional history (other than banking details) about your e-commerce activities;
3.7 Correspondence Information: Content, information about your correspondents, and the destination/origin of communications between you and any other person using the Platform, which include email communications, blog, chat room and discussion board communications, instant message communications, experts forum communications, fax mail communications, membership of mailing lists etc.;
3.8 User IDs: Your usernames, passwords, email addresses and other security-related information used by you in relation to Platform usage; and
3.9 Stored Information: Data either created by you or by a third party and which you wish to store on our servers or you provided during the interaction with our Platform and its staff such as image files, audio, video recordings or documents etc.
To make it easier to manage your reservations, OurBus India may provide a facility for the End-User to open a user account on the Platform. The user account may allow you to save your personal settings, review previous bookings and manage future reservations.
When you use the Platform, even if you do not make a booking/reservation, we may collect certain information, such as, your IP address, or browser, and information about your computer’s operating system, application version, language settings and content / pages that have been shown to you. If you are using a mobile device, we might also collect data that identifies your mobile device, device-specific settings and characteristics and latitude/longitude details.
We may collect personal data about you from you, our affiliates, third parties, and from other sources, including without limitation business partners (such as logistics or payment service providers), credit bureaus, marketing service providers or partners, referral or loyalty programs, other users of our Services or publicly available or governmental sources of data.
In some situations, you may provide personal data of other individuals to us (such as your family members or friends or persons in your contact list). If you provide us with their personal data, you represent and warrant that you have obtained their consent for their personal data to be processed in accordance with this Policy.
You agree not to submit any information to us which is inaccurate or misleading, and you agree to inform us of any inaccuracies or changes to such information. We reserve the right at our sole discretion to require further documentation to verify any information provided by you.
If you sign up to be a user of our Platform using your social media account (“Social Media Account”), link your OurBus India account to your Social Media Account or use any OurBus India social media features, we may access information about you which you have voluntarily provided to your Social Media Account provider in accordance with such provider’s policies, and we will manage and use any such personal data in accordance with this Policy at all times.
(Collectively, the above End-User’s data along with the ‘Targeting Data (defined below)’ shall be hereinafter referred to as the “End-User’s Data”)
In this regard, it may be noted that inter alia the following amongst others items specified there under shall be governed by the Cookie Policy of the Platform:
(a) Platform usage dealing with information about your navigation during the Platform usage, for example the URLs of Platforms;
(b) log information: information, such as, your web request, IP address, browser type, browser language, date and time of request.
Users outside the geographical limits of India:
Please note that the data shared with OurBus shall be primarily processed in India and such other jurisdictions where a third party engaged by OurBus may process the data on OurBus’s behalf. By agreeing to this policy, you are providing OurBus with your explicit consent to process your personal information for the purpose(s) defined in this policy. The data protection regulations in India or such other jurisdictions mentioned above may differ from those of your country of residence.

4. Purpose of Using End-User’s Data:
Customer Service: OurBus India may use the End-User’s Data for providing customer services to the End-User.
Account Administration:
OurBus India may offer to user the facility to register and open an account on the Platform. OurBus India may use the information you give to OurBus India for administering the account, allowing you to manage your bookings, take advantage of special offers, and manage your personal settings.
Marketing Activities:
We may also use your information for marketing activities, as permitted by applicable laws, such as, the following:

There may be other times when we get in touch by email, by post, by phone or by texting you, depending on the contact information you share with us. There could be a number of reasons for this, such as, the following:

We may use the End-User’s Data for the detection and prevention of fraud and other illegal or unwanted activities or disclose the End-User’s Data if required as per the applicable laws.
Improving Our Services:
We may use the End-User’s Data for analytical purposes, to improve our Platform, enhance the user experience, and improve the functionality and quality of our Platform.
In certain circumstances, we may share the End-User’s Data with third parties, such as, the following:
User’s Bookings:
In order to complete your booking, we need to transfer relevant reservation/booking related End-User details to the bus, train or ferry operator you booked with.
OurBus India’s Local Platform’s Office:
In order to support you during the reservation/booking process and throughout your stay, your details may be shared with any of the group companies of OurBus India. Your information might also be shared with other members/services providers to the Platform/group companies for analysis to provide you with travel-related offers that may be of interest to you and to offer you a customized service.
Third-Party Service Providers:
We may use third-party service providers to process the End-User’s Data on our behalf for the purposes specified above. To further elaborate in this regard, we may use service providers to send the reservation/booking information on our behalf to the operator you booked through the Platform, or we may instruct third parties to contact you. When a reservation/booking requires it, we may also work with third-party payment service providers to facilitate payment or payment guarantees.
Our Platform uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on your device, to help the Platform analyse how Users use the Platform. The information generated by the cookie about your use of the Platform (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Platform, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage, as detailed in Google’s Business Data Responsibility Site. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.
We also work with third-party advertisement networks to market our Platform on other platforms, or involve third-party providers for analytical purposes. These third parties involved in any of these services will be bound by confidentiality agreements and will not be allowed to use the End-User’s Data for any purposes other than those specified above.
How long do we keep your data
OurBus will retain your Personal Information on its servers for as long as is reasonably necessary for the purposes listed in this policy. In some circumstances we may retain your Personal Information for longer periods of time, for instance where we are required to do so in accordance with any legal, regulatory, tax or accounting requirements.
Where your personal data is no longer required we will ensure it is either securely deleted or stored in a way which means it will no longer be used by the business.
Disclaimer
We do not guarantee the security of personal data and/or other information you provide on third-party sites. While we implement a variety of security measures to protect your personal data that is in our possession or control, including storing it behind secured networks accessible only to authorized personnel, and using secure servers for processing orders and accessing personal data, we cannot ensure the security of data on third-party platforms. All personal data or sensitive information you provide is encrypted in our databases and can only be accessed as described above.
To enhance your experience, we may link to or frame content from various third-party websites within our Platform. We may also collaborate with partners through co-branding and other relationships to offer e-commerce and additional services and features to our visitors. These linked sites have their own separate privacy policies and security measures, independent of ours. Even if these third parties are affiliated with us, we do not control their privacy and data collection practices. Consequently, any data collected by our co-brand partners or third-party websites (even if offered through our Platform) may not be shared with us.
Therefore, we are not responsible or liable for the content, security practices, or activities of these linked sites. These links are provided for your convenience, and you access them at your own risk. Nonetheless, we are committed to maintaining the integrity of our Platform and the links included within it, and we welcome any feedback regarding these linked sites (including, for example, if a specific link is not functioning properly).
5. Use of End-User’s Data on Mobile Devices:
We may provide free apps for a variety of mobile devices and use versions of our regular Platform that have been optimised for mobile. These apps and mobile Platforms process the End-User’s Data in a similar way as our Platform does and they also allow you to use location services to find suitable bookings for the End-User.
6. Use of Targeting Data (defined below) for Retargeting:
The Platform may utilize (i) a tracking pixel (such as, a smart pixel(s) or managed pixel(s)) (“Pixel”) placed on certain page(s) of the Platform to collect relevant information from the Platform and to set a cookie on the browser of End-User(s), (ii) browser stream data of End-User(s) to the Platform or (iii) other non-identifiable / non-personal information of the End-User (collectively, hereinafter referred to as the “Targeting Data”).
7. Cookies
We or our authorised service providers and advertising partners may from time to time use “cookies” or other features to allow us or third parties to collect or share information in connection with your use of our Services or Platform. These features help us improve our Platform and the Services we offer, help us offer new services and features, and/or enable us and our advertising partners to serve more relevant content to you, including through remarketing. “Cookies” are identifiers that are stored on your computer or mobile device that record data about computer or device, how and when the Services or Platform are used or visited, by how many people and other activity within our Platform. We may link cookie information to personal data. Cookies also link to information regarding what items you have selected for purchase and web pages you have viewed. This information is used to keep track of your shopping cart, to deliver content specific to your interests, to enable our third party advertising partners to serve advertisements on sites across the internet, and to conduct data analysis and to monitor usage of the Services.
You may refuse the use of cookies by selecting the appropriate settings on your browser or device.
However, please note that if you do this you may not be able to use the full functionality of our Platform or the
Services.
8. End-User’s Data Security Safeguards:
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.
9.1. Site Access Control
Prevent unauthorised persons from gaining access to data processing sites that process and use data.
9.2. System Access Control
Prevent data processing systems from being used without authorization.
9.3. Data Access Control
Ensure that persons authorised to use a data processing system have access only to the data they are authorised to access, and that data cannot be read, copied, modified, or removed without authorization during processing, use and storage.
9.4. Disclosure Control
Ascertain and check where and to whom data can be transferred by means of data transmission facilities.
9.5. Input Control
Perform checks & maintain audit logs to establish whether and by whom data has been entered, modified, or removed in the data processing system.
9.6. Order Control
Ensure that personal data processed on behalf of a customer is processed in strict accordance with the customer’s instructions.
9.7. Availability Control
Ensure that data is protected against accidental destruction or loss.
9.8. Notification Control
Ensure that the customer is notified promptly in the event of a material breach of any of the controls above. Any breach of confidential data is notified to the customer within 72 hours of ascertaining such breach.
10. Data Retention
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for a period ranging from six – seven years, depending on the regulation after they cease being customers for tax purposes. In some circumstances you can ask us to anonymise your personal data after a specific period of non-use of services.
If the End-User’s Data we have for you is incorrect, we will update it at your request. You can also ask us to remove your End-User’s Data from our customer database by sending an email to support@OurBus.com with “Request for removal of End-User’s Data” in the subject line. However, where you choose to remove your End-User Data, we may not be able to provide you with access to the Platform for making reservations/bookings. We may also need to retain certain information in accordance with applicable laws, for legal or administrative purposes, such as record keeping or to detect fraudulent activities.
9. Amendment / Modification:
OurBus India reserves the right to modify this Privacy Policy at any time with or without any further notice(s) by uploading the revised Privacy Policy on the Platform and it is the duty of the End-User to keep itself aware of the revisions to the Privacy Policy of the Platform.
10. Limitation of Liability:
The Platform will not be liable for any damages of any kind, including without limitation direct, indirect, incidental, punitive, and consequential damages, arising out of or in connection with the privacy policy, the facility provided on the Platform, the transaction processing facility, the inability to use the facilities provided on the Platform including the transaction processing facility, or those resulting from any services purchased or obtained or messages received or transaction entered into through the Platform beyond the value of the last transaction carried out by the end user through the Platform.
11. Miscellaneous:
The Parties acknowledge and accept that electronic format shall be deemed an acceptable means of communication for the purposes of this Private Policy.
This Privacy Policy constitutes the complete and entire agreement between the Parties on the subject of ‘privacy norms of the Platform’ (save and except the Cookie Policy) and shall supersede any and all other prior understandings, commitments, representations or agreements, whether written or oral, between the Parties to this Privacy Policy.
If any provision of this Privacy Policy shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or enforceability shall not affect the other provisions of this Privacy Policy, which shall remain in full force and effect.
In no event will any delay, failure or omission (in whole or in part) in enforcing, exercising or pursuing any right, power, privilege, claim or remedy conferred by or arising under this Privacy Policy or by law, be deemed to be or construed as a waiver of that or any other right, so as to bar the enforcement of that, or any other right, power privilege, claim or remedy, in any other instance at any time or times subsequently.
Permissions required for using the OurBus App
When the OurBus app is installed on your phone or tablet, a list of permissions appear and are needed for the app to function effectively. There is no option to customize the list.
The permissions that OurBus requires and the data that shall be accessed and its use is as below:
Android permissions:
Device & App history: We need your device permission to get information about your device, like OS (operating system) name, OS version, mobile network, hardware model, unique device identifier, preferred language, etc. Basis these inputs, we intend to optimize your travel booking experience, use OS specific capabilities to drive great in-funnel experiences using components of device’s OS, etc.
Camera: This permission enables you to use your camera from within the application to upload a new profile picture, upload an image for sharing hotel reviews and also allows you to take videos to upload as video reviews on our application. This permission will also enable you to scan QR codes for easy UPI payments.
Identity: This permission enables us to know about details of your account(s) on your mobile device. We use this info to auto-fill your email ID’s and provide a typing free in-funnel experience. It helps us map email ID’s to a particular user to give you the benefit of exclusive travel offers, wallet cash-backs, etc. It also allows facilitating your Facebook and Google+ login.
Location: This permission enables us to give you the benefit of location specific deals and provide you a personalized in-funnel experience. When you launch OurBus app to make a booking, we auto-detect your location so that your nearest location is auto-filled. We also require this permission to recommend you the nearest boarding point. Your options are personalized basis your locations. For international travel, this enables us to determine your time zone and provide information accordingly
SMS: If you allow us to access your SMS, we read your SMS to autofill or prepopulate ‘OTP’ while making a transaction and to validate your mobile number. This provides you a seamless purchase experience while making a booking and you don’t need to move out of the app to read the SMS and then enter it in the app.
Phone: The app requires access to make phone calls so that you can make phone calls to our customer contact centers directly through the app.
Contacts: If you allow us to access your contacts, it enables us to provide a lot of social features to you such as sharing your booking details with your friends, inviting your friends to try our app, send across referral links to your friends, etc.
Photo/ Media/ Files: The libraries in the app use these permissions to allow map data to be saved to your phone's external storage, like SD cards. By saving map data locally, your phone doesn't need to re-download the same map data every time you use the app. This provides you a seamless Map based Hotel selection experience, even on low bandwidth network.
Wi-Fi connection information: When you allow us the permission to detect your Wi-Fi connection, we optimize your experience such as more detailing on maps, better image loading, more hotel/ flights/ package options to choose from, etc.
Device ID & Call information: This permission is used to detect your Android ID through which we can uniquely identify users. It also lets us know your contact details using which we pre-populate specific fields to ensure a seamless booking experience.
Calendar: This permission enables us to put your travel plan on your calendar.
Bluetooth: This permission enables us to provide you services of the third parties that make available certain features of their products/services on our application. The permission specifically enables our third party service providers whose services you book on the application to permit you to lock and unlock your self-driven vehicles seamlessly.
Video/Audio: This permission enables you to upload videos on our application or to submit video reviews of your hotel/property stays and thereby providing you with new ways of providing reviews of your experience on our application. The audio permission enables us to ensure that the video content that you upload has a clear audio in its background.
Phone Number: We need the permission of access to phone number to provide a seamless login experience, to optimise your travel booking experience and to enable you to obtain UPI services and to prevent fraud in some cases on our application
IMEI/IMSI: This permission enables us to identify different users uniquely and helps us to prevent frauds on our application.
Subscription Information: Your subscription information enables you to provide you a seamless experience depending upon your network and to optimise the application’s performance. In addition this also enables us in providing to you the train status even in an offline mode and additionally even in a no network area you can get fully aware of the status of the train you want to search for.
SIM Serial Number: This permission enables us to read your sim serial number and helps us in authenticating your mobile number for UPI registration. It helps us to ensure that the mobile number you are using is actually present on your device that you are using to register for UPI.
IOS Permissions:
Notifications: If you opt in for notifications, it enables us to send across exclusive deals, promotional offers, travel related updates, etc. on your device.
Contacts: If you opt in for contacts permission, it enables us to provide a lot of social features to you such as sharing your booking details with your friends, inviting your friends to try our app, send across referral links to your friends, etc. This information will be stored on our servers and synced from your phone.
Location: This permission enables us to give you the benefit of location specific details and provide you a personalised in-funnel experience. When you launch our app to make a travel booking, we auto-detect your location. We require this permission to recommend your nearest boarding and dropping points.
